Khula is the legal process where a woman can seek separation from her husband after he refuses to proceed. It’s the right given to the woman in Islam and under the Law of Pakistan.

In Urdu, Khula (خلع) simply means a wife’s right to initiate divorce, typically by returning the dower (mahr) to the husband in compensation for divorce.

Conditions to Initiate a Khula Process

A woman can initiate the Khula or judicial divorce without her husband’s consent under Family Law 1961 and the Muslim Marriage Act 1939 only if:

  • Show her genuine will and consent to seek Khula from her husband.
  • The Khula is initiated only if the woman is not determined to live with the husband
  • Surrenders her financial rights
  • Return her haq mehr or dower amount (if not paid)
  • Returns the amount of haq mehr (if paid)

Grounds of Khula

The reasons a Muslim women seek Khula in Islam are

  • If abandoned by husband for a minimum of four years
  • It suffers physical, financial, or emotional harm from the husband.
  • Failure to maintain a marriage for a minimum of two years
  • Husband is into more than one marriage contract
  • Husband is in prison for a minimum of seven years
  • If the husband fails to perform marriage obligations for a minimum of three years
  • Severe illness of the husband for a minimum of two years
  • If the husband is not able to do justice between more than one wife
  • If a woman is forced into a contract marriage before the legal age, she can petition for Khula before the age of 18.
