Divorce by Husband

In Islam, the marriage contract can be dissolved at any point through Divorce, which is the husband’s right if he is not happy with his wife. However, the Talaq must be carried out with respect and proper legal documentation.

The proper Islamic way of giving divorce to the wife includes saying the word “Talaq” three times with clear intentions. However, the verbal triple Talaq is not recognized by the Law of Pakistan.

Divorce by wife or Talaq-e-Tafweez

In Islam, a woman can seek Khula, but there is another right that can be followed only if the woman has been given the right of divorce in her Nikah Nama under Clause 18. This way, she can follow the same procedure of Talaq.

The wife can also be given the power to divorce her husband, under the section of the Muslim Family Law Ordinance (VIII of 1961).

Mutual Divorce or Mubarat

The Islamic Marriage Contract can be dissolved if the husband and wife both agree on the dissolution. Both of them sign a Mutual Divorce Deed, and then a written notice is sent to the union council under section 8 of the Muslim Family Law Ordinance.

Preparation of the Divorce deed

The divorce deed is prepared by mentioning the following information:

  • A brief history of marriage
  • Description of children
  • Amount of Haq Mehr
  • The amount of Haq Mehr is paid, and the receipt is attached to the original divorce papers.
  • Once the Divorce Deed is prepared, it is sent to the recipient via mail.

The legal procedure for Divorce is as follows:

Pronouncement of Talaq

The husband pronounces Talaq both orally and by the deed of Divorce 

Written Notice to Union Council

A written notice is sent to the concerned union council mentioning the address of his now ex-wife.

Notice of Divorce to the Wife

The concerned union council sends a copy of the notice of Divorce to the ex-wife.

Reconciliation Process (Iddat Period)

The Union Council issues a notice to both parties for any reconciliation.

Hearing for reconciliation

A lawyer can also appear on behalf of the applicant in the hearing. If the reconciliation fails, the woman is asked to complete her Iddat period.

Once the Iddat period of 90 days has ended, the union council issues a divorce certificate to both husband and wife.

Wife’s right to property after Separation in Pakistan

Even after separation, the dowry or jahaiz given to the bride is the exclusive property of the wife. If any item is delayed upon the divorce, the wife can claim these items. The wife can also request maintenance money during the Iddat period of 90 days.
